B-1 Visas

B-1 Visas are appropriate for those individuals who wish to engage in any of the following business activities while in the U.S.:

  • Attend scientific, educational, professional, business, or religious conventions
  • Work on specific projects in the U.S. and paid by a foreign employer
  • Participate in commercial transactions (which do not involve gainful employment) such as negotiating contracts and consulting with business associates
  • Undertake independent studies such as feasibility studies, market research or any such activity
  • Attend professional or business conferences, workshops, or seminars
  • Explore possibilities to set up a subsidiary of a foreign corporation, or to make investments
  • Attend meetings as a member of the Board of Directors of a U.S. corporation
  • Observe business, professional, or vocational activity as long as it does not involve any hands-on activity
  • Conduct business consultations with business associates in the U.S.
  • Act as purchasing agents of a foreign employer to come to the U.S. to procure goods, components, or raw materials for use outside the U.S.
  • Participate in court proceedings in the U.S.
  • Install or service equipment in the U.S. on behalf of a foreign company pursuant to a contract of sale or to provide after sales service

H-1B "Specialty Occupation" Visas

H1-B Visas are appropriate for those individuals who meet any of the following criteria:

  • Foreign professionals, such as scientists, engineers, programmers, research analysts, management consultants, journalists, accountants, and others with Bachelor's or any equivalent combination of education and experience relevant for the H-1B position
  • Foreign professionals involved in cooperative research and development projects administered by the U.S. department of defense
  • U.S. Licensed Physical Therapists
  • U.S. Licensed Physicians 
  • Professional Nurses entering the U.S. to supervise nursing operations

 

L-1A "Executive/Manager" Visas

L-1A "Executive/Manager" Visas are appropriate for those individuals who meet any of the following criteria:

  • Foreign national executives being transferred to the U.S. to manage an organization or a major function or division of an organization

  • Foreign national managers being transferred to the U.S. to supervise work of other supervisory, professional or managerial employees, or who manages an essential function, department or subdivision

  • Employees and partners of international accounting firms

  • Multinational companies to transfer foreign national executives to manage an organization or a major function or division of an organization in the U.S.

  • Multinational companies to transfer foreign national managers to supervise work of other supervisory, professional or managerial employees, or who manages an essential function, department or subdivision in the U.S.

L-1B "Specialized Knowledge Employee" Visas

L-1B "Specialized Knowledge Employee" Visas are appropriate for those individuals who meet the following criteria:

  • Specialized Knowledge employees of companies outside U.S. that have related U.S. branches, subsidiaries, affiliates or joint venture partners
  • Multinational companies to transfer employees with specialized knowledge such as, its products, research methods and marketing techniques

EB-1 Green Cards

Employment Based Green Cards under the First Preference Category (EB-1) are appropriate for those individuals who meet any of the following criteria:

  • Foreign nationals who have received national or international acclaim for outstanding achievements in Arts, Sciences, Education, Business or Athletics
  • Outstanding professors and researchers who have at least three years experience in teaching or research in their field and received international recognition for their work
  • Executives of multinational companies managing an organization or a major function or division of an organization
  • Managers of multinational companies supervising the work of other supervisory, professional or managerial employees
  • Managers who manage an essential function, department or subdivision
  • Multinational companies to sponsor the Green Card application for their executives and managers
  • U.S. Universities to sponsor the Green Card application for foreign national professors and researchers with outstanding abilities

  • Immediate family members of EB-1 Green Card applicants

EB-2 Green Cards*

Employment Based Green Cards under the Second Preference Category (EB-2) are appropriate for those individuals who meet any of the following criteria:

  • Foreign professionals with an advanced university degrees (masters degree or higher) and a job offer from a U.S. company
  • Foreign professionals with a baccalaureate degree and five years of progressive experience in the job offered and a job offer from a U.S. company
  • Foreign nationals with exceptional ability in the sciences, business or arts and with a job offer from a U.S. company
  • U.S. companies to sponsor the Green Card application for foreign professionals holding advanced university degrees, or persons with exceptional ability in the sciences, business, or arts
  • Universities to sponsor the Green Card application for foreign national professors and researchers of exceptional ability

  • Immediate family members of EB-2 Green Card applicants.

EB-3 Green Cards*

Employment Based Green Cards under the Third Preference Category (EB-3) are appropriate for those individuals who meet any of the following criteria:

  • Professionals with a U.S. bachelor's or foreign equivalent degree and a job offer from a U.S. company
  • Skilled workers with at least two years of training and/or experience and a job offer from a U.S. company
  • Unskilled workers with less than two years training or experience and a job offer from a U.S. company
  • U.S. companies to sponsor the Green Card application for professional, skilled or unskilled foreign nationals
  • Immediate family members of EB-3 Green Card applicants


*All EB-2 and EB-3 petitions must be filed with a Certified Application for Permanent Employment (Labor Certification).

To be eligible to obtain the Foreign Labor Certification under current regulations, the employer must meet the following requirements:

  • There must be a bona fide job opening;

  • Job requirements must adhere to what is customarily required for the occupation in the U.S. and may not be tailored to the worker's qualifications;

  • The employer must document that the job opportunity has been and is being described without unduly restrictive job requirements, unless adequately documented as arising from business necessity; and

  • The employer must pay, or demonstrate ability to pay, at least the prevailing wage for the occupation in the area of intended employment
